Employer terms
Last updated
The terms include liability exclusions, your indemnity obligations and our right to withdraw free posting.
Who these terms are between
These terms are an agreement between Idealweb (Pty) Ltd ("we"), which operates IdealJobs, and the business that registers an employer account ("you"): an employer, or a recruitment agency that advertises for its clients. By ticking the box on the registration form, the person who registers confirms that the business has authorised them to accept these terms for it, and accepts them for the business. You must make sure that the people you make owners or administrators of the account have your authority to act for you.
Who may register
We accept registered businesses in South Africa, and other businesses we agree to accept. Register with your own work email address unless we have agreed otherwise. The details you give about the business, including its name, website and registration number, must be true and kept current, and we may ask for documents to confirm them. Accepting a registration or approving an account does not oblige us to keep the account open or to publish an advert.
Your account
The account belongs to the business. Keep its sign-in details to yourselves and tell us promptly if you think somebody else has used it. You are responsible for what is done on the account by the people you invite or allow to use it. We may ask a colleague who registers separately to join your account instead.
Agencies advertising for clients
A recruitment agency may advertise vacancies for its clients. If you do, you confirm that you have the client's authority to advertise each vacancy and that the advert says what the client has told you about the job. You answer to us for those adverts as you would for vacancies of your own.
Your profile and your adverts
Your profile must describe the business as it is. An advert must be for a real vacancy, described honestly: the work, what you need, where it is, and either the pay or that it is market related. Keep it current and take it down when the job is filled. You own what you write, and you give us permission to publish it on IdealJobs and wherever its adverts appear, including search engines and job alerts. Our writing help offers drafts; you are responsible for the advert you publish.
The advert rules
An advert may not carry contact details (an email address, telephone number, website or messaging handle) or a way to apply other than the button on the advert. Applications reach you through IdealJobs. One advert for each vacancy, a title that says what the job is, and pay stated as it is.
No fees to applicants
You may not ask an applicant for money, at any stage and for any reason: no registration fee, no training fee, no uniform deposit, no fee for a background check. The Employment Services Act forbids charging a work seeker a fee for employment services, and on this site the same rule applies to every advertiser, because a request for money is the mark of a scam. We may remove an advert that asks for money and close the account.
No unfair discrimination
An advert may not set a requirement that unfairly discriminates on a ground listed in section 6 of the Employment Equity Act, among them age, race, gender, pregnancy, marital status, family responsibility, disability, religion, HIV status, sexual orientation, culture, language and birth, unless it is an inherent requirement of the job and you can say why. Whether a requirement is lawful is yours to decide and answer for; we may decline adverts where it plainly is not.
Review of accounts and adverts
We may review an account or an advert before or after it appears, by a person or with automated tools, and we may decline, remove or end either. We are not obliged to review, and a review is not our approval of what an advert says: you remain responsible for it. We may give the reason for a decision, and may reconsider one if you ask, without undertaking to do so in every case. What appears on IdealJobs is our decision.
Applicants' information: your responsibility
When an application reaches you, you decide why and how the applicant's information is used for your recruitment, and you are the responsible party under the Protection of Personal Information Act for that use. Use it for the vacancy applied for, and for other lawful recruitment purposes where you have given the applicant the notice, and have the lawful basis, that the Act requires. You may pass it to the client you are recruiting for and to service providers who need it, where that is lawful and the applicant has been told. Do not sell it. Keep it no longer than you lawfully may, and answer applicants who ask to see, correct or delete what you hold.
What we do with applications for you
Where we hold and handle applications on your behalf, we act as your operator, and this section is our written contract for that. We process them only with your knowledge or authorisation, which these terms and your use of the account give. We treat them as confidential and do not disclose them unless the law requires it or our duties under these terms need it. We maintain appropriate, reasonable technical and organisational measures against loss, damage, unauthorised destruction and unlawful access. We use service providers, some of them outside South Africa. If there are reasonable grounds to believe that applicant information we hold for you has been accessed or acquired by an unauthorised person, we will notify you immediately.
What we do for our own purposes
We are the responsible party for what we do with information for our own purposes. These include running job seekers' own accounts and profiles, keeping IdealJobs safe and lawful (which includes reviewing adverts and looking into reports and misuse), keeping records of what was accepted and consented to, measuring and improving the service, and meeting our legal duties. Our privacy notices describe this. For those activities we are not your operator, and your instructions do not govern them.
Applicants, and the decisions about them, are yours
We show your advert to job seekers and bring their applications to you. Tools on IdealJobs may read a CV or sort applications to help you; they do not decide for you. You decide whom to interview, hire or turn down, and you answer for those decisions and for the law that applies to them. We do not verify what applicants say about themselves.
The free service, and our rights over it
The service is free at present. We may change, restrict, suspend or withdraw the free service, any feature or allowance, any account and any advert, including an advert that has not reached its displayed end date. We may do so at our discretion, at any time, with or without notice, and for any lawful commercial or operational reason, subject to applicable law. The approval of an account, a posting allowance and the displayed duration of an advert are not undertakings that the account, the allowance or the advert will remain available.
Prices
If we introduce prices for any part of the service, a price applies to you once you have accepted it and the terms that go with it, and not before. We do not move a free account to a paid subscription without your express acceptance. If you do not accept, we may limit or end the free service for you.
Limits
The free service has limits, including on the number of adverts, how long an advert runs, the number of people on an account and the writing help included. The limits that apply are shown in your account. We count usage, and we may change the limits.
Suspension and closing
If we suspend or close an account, its adverts come off IdealJobs. We may give reasons, and may reconsider a decision if you ask, without undertaking to do either or to restore an account as it was. You may close your account at any time by writing to us. The employer privacy notice says what happens to information when an account closes.
How we contact you
We may contact the people on your account by email or telephone about the account and the service: to verify details, to administer the account, to give support, to clarify a vacancy, to help with posting, to tell you about applications, and about security and changes to the service. These are service communications: they are part of the service, continue whatever you choose about marketing, and are not used to promote other products.
Marketing is optional
Marketing is separate from these terms and is not a condition of the service. Idealweb (Pty) Ltd may email or call a person about its recruitment software and services, which include IdealJobs and Recruit 360, where that person has agreed to it. Each person chooses for themselves, and a colleague's choice does not count for another. A person may withdraw at any time, free of charge, for email, for calls or for both: in the account's settings, by writing to us or, for email, from the link in a marketing email. Declining or withdrawing does not prevent registration, close the account or remove adverts.
The service as it is
The free service is provided "as is" and "as available". We give no warranty or undertaking that it will be available, uninterrupted, secure or free of errors; that an advert will draw any number of applications or lead to a hire; that applicants, or what they tell you, are accurate or suitable; that what automated or AI tools produce, including drafts, checks, summaries and scores, is accurate or complete; or that information will be stored, backed up or recoverable. Keep your own copies of what you need.
Our liability
To the maximum extent that applicable law permits, we are not liable to you for any loss or damage arising from or connected with the free service or these terms. This applies to direct, indirect, special and consequential loss, and to claims in contract, in delict (including for negligence) or on any other basis. It includes loss of profit, revenue, business, opportunity or goodwill; information that is lost, corrupted or unavailable; interruptions and errors; notifications or applications that are delayed or do not arrive; and an advert or account that is declined, removed, suspended or ended, or a service that is changed or withdrawn.
What the law does not allow us to exclude
These terms do not exclude or limit a liability or a right that the law does not allow to be excluded or limited. That includes liability for fraud and intentional misconduct; liability for gross negligence, where the Consumer Protection Act applies to you; and rights you have under that Act or the Protection of Personal Information Act. Where a law limits how far liability may be excluded, our liability is excluded as far as that law allows and no further. These terms do not take away a right of an applicant or a power of a regulator.
Your responsibility to us
You indemnify us against claims made by others, including applicants, employees, your clients and regulators, and against the loss and reasonable legal costs that follow, to the extent that they arise from your adverts or instructions, your use of applicants' information, your recruitment or employment decisions, what is done on your account, or your breach of these terms or the law. We will tell you of a claim promptly, may conduct or settle our own defence acting reasonably, and may ask for your reasonable help, which you must give. This does not cover loss to the extent that our own fraud, intentional misconduct or gross negligence caused it.
Changes to these terms
We may publish a new version of these terms. We give notice of a material change by email to the account before it takes effect. A new version applies to use of the service from its effective date; if you do not agree, you may close the account. A notice period for a change to these terms does not delay or limit the rights we already have under the version you accepted, including the right to change, suspend or withdraw the service, an account or an advert. We keep a record of the versions and of acceptances.
General
Notices go to the email address on your account and count as received on the working day after they are sent. These terms, with the employer privacy notice, are the whole agreement for the free service; a web page or an email does not add a promise to them. If part of these terms cannot be enforced, the rest still stands. You may not transfer the account or these terms to anybody else without our agreement; we may transfer them to a successor to our business.
Governing law
These terms are governed by the law of the Republic of South Africa, and the courts of South Africa decide any dispute about them.
Employer privacy notice
This part is about you and your colleagues, not about the people who apply to you. What happens to an applicant’s information is in our privacy notice for job seekers.
Who this notice is from, and who it is for
Idealweb (Pty) Ltd operates IdealJobs and is the responsible party for the information this notice describes. The notice is for the people who register, own or use an employer account. Information about applicants is covered by the job-seeker privacy notice, and by the notices you give applicants as an employer or agency.
What we hold about you
Your name, work email address and telephone number; the business's name, website and registration number, and any documents you send to confirm them; the address your device connected from and the browser it used; a record of the terms you accepted and of each marketing choice you made or withdrew, with its date, wording and channel; your adverts and what you do on the account; and what you write to us.
Why we use it
To open, verify and run the account; to contact you by email or telephone about the account, your adverts, the applications you receive, support, security and changes to the service; to review adverts and keep IdealJobs safe and lawful; to keep records of what was accepted and consented to; to measure and improve the service; and to meet legal duties. We do this because it is needed for our agreement with the business, for our legitimate interests in running a safe service, or to comply with the law. Marketing depends on your own choice, which the next section describes.
Marketing
Marketing is optional. If you agree, Idealweb (Pty) Ltd may email or call you about its recruitment software and services, which include IdealJobs and Recruit 360. You may withdraw at any time, free of charge, for email, for calls or for both: in your settings, by writing to us or, for email, from the link in a marketing email. We keep a record of what you agreed to, when, in which words and for which channels, and of each withdrawal, and we keep your address on a do-not-send list so that a withdrawal is respected. Service communications continue.
Who receives it, and where it is processed
We use service providers for hosting, email, network delivery and protection, usage measurement, address look-up and automated tools that read and check adverts. The account and its records are stored in South Africa. Some of these providers process information in other countries. We do not sell your information. We disclose it where the law requires it.
How long we keep it
We keep account information while the account is open. When an account is closed we delete or de-identify what we no longer need. We keep, for as long as each is needed or the law allows: the record of what was accepted, consented to and withdrawn; the do-not-send list; security and audit logs; records of adverts published and of decisions about them; what we need for a legal claim or duty; and copies in backups until those backups expire. Documents sent to verify the business are kept for that purpose.
Your rights, and who to ask
You may ask us whether we hold information about you and for a copy of it, ask us to correct or delete it, and object to our use of it, and we will respond as the Protection of Personal Information Act requires. Write to [email protected]. You may also complain to the Information Regulator of South Africa.
